The mother of the petitioner was serving as a Staff Nurse at Government Medical College, Nagpur. She died in harness on 26.09.2006. Her daughter who is the petitioner's sister came to be appointed on compassionate ground on 05.12.213. According to the petitioner, since his sister was not keeping good health, a request was made to replace his name in place of his sister and grant him compassionate appointment. The Maharashtra Administrative Tribunal held that in view of grant of compassionate appointment to the petitioner's sister, her name cannot be replaced by another. 2.

We do not find that the Tribunal has committed an error in dismissing the Original Application. The compassionate appointment having already been granted there is no question of substituting the employee who was already appointed by another. The writ petition is dismissed with costs.
