The hostel of petitioner was found to be not functioning from 6.8.2011 due to internal dispute in the Management. It's recognition was, therefore, cancelled. The appeal preferred by the petitioner against that order is also dismissed on 2.6.2014. It appears that, in the meanwhile, closed hostel was handed over to respondent no.4 and on 27.12.2014, when it was visited again, it was found closed.

The petitioner/Management is assailing the order of appellate Authority in these proceedings. However, after hearing the learned Counsel, we find nothing on record to show that, after 6.8.2011, the hostel was functioning and the students were residing there.

We have heard the learned A.G.P. also. He

274wp2418.15 2/2 points out that, in the Writ Petition, this finding of fact has not been assailed at all.

In this situation, no case is made out. Hence, the petition is rejected. No costs.
