This is an Application moved by the Applicant/Original Claimant for codonation of delay in filing the Appeal.

Shri. S. R. Chakravarti, learned Counsel for Applicant and Ms. Anita Mategaonkar, learned Counsel for Non-Applicant No.1/Insurance Company. The NonApplicant No.2/Maharashtra State Power Generation Company Ltd, though served is not appearing.

The Applicant is the original claimant. His claim petition was partly allowed by the Motor Accident Claims Tribunal-4, Nagpur on 15.09.2019. Being dissatisfied with the same, he approached to this Court by filing the Appeal, but since there is delay, he moved present Application. The delay is of 453 days. 4.
The learned Counsel Ms. A. Mategaonkar for NonApplicant No.1 opposed the present Application.

After hearing the learned Counsel appearing for the parties and after having gone through the contents of the Application, which are on afÏdavit, I am of the view that the Applicant has satisfactorily explained the delay. In that view of the matter, I pass the following order :
O R D E R
i) Civil Application No.1935 of 2021 is allowed. ii) Delay in filing the Appeal stands condoned.
