This matter pertains to mutation entry. It has come on record that the Sub-Divisional Officer has observed numerous illegality and irregularity committed in respect of the mutation entries in question. However, Additional Collector, Gondia and Additional Commissioner, Nagpur both have reversed the said order of the Sub-Divisional Officer, Deori, District Gondia.

At this stage the fact that, the petitioner has filed the suit for declaration and permanent injunction relating to land in question and the suit has reached to SKNair

40-wp-2541-21.odt the stage of recording of evidence is pointed out by the parties.

Thus, at this stage, I am not inclined to interfere in the present matter for the reasons that any observations made in this writ petition may cause prejudice to any of the parties and the learned trial Court may get influenced by such observations. 5.

Furthermore, it is a settled law that the revenue entry does not create any title and therefore whatever may be the outcome of the suit it would be binding on the revenue authorities to carry out correction in the revenue entry, if necessary. 6.

In that view of the matter, the writ petition is disposed of.
