The applicant is arrested on 31st March, 2015 in crime registered against him for the offences punishable under Sections 302 and 498-A of the Indian Penal Code. The application is opposed mainly on the ground that there is ample material against the applicant showing his involvement in the crime and as rightly recorded by the learned Additional Sessions Judge while rejecting the application filed by the applicant seeking bail that he has not filed any document to give details of his permanent residence and if he is released on bail he may abscond. The learned advocate for the applicant has submitted that the applicant may be released on bail as he is ready to furnish solvent surety of his father Tukaram Nura Pawar and paternal uncle Atmaram Dharamsingh Pawar, both residents of Barshi Takali, District : Akola.

2 ba302.17 The charge-sheet is filed in 2015. The nonapplicant has not been able to show that custody of the applicant is required for further investigation. Considering the facts of the case, in my view, the applicant is entitled to be released on bail, however, on the condition as imposed by this order.

Hence, the following order:

The applicant having been arrested in Crime No. 32 of 2015, registered by the non-applicant, he be released on bail on executing P.R. bond for Rs.Fifty Thousand and two solvent sureties in the like amount. One Solvent Surety shall be by his father Tukaram Nura Pawar and another solvent surety shall be by his uncle Atmaram Dharamsingh Pawar. The applicant shall attend the trial before the Sessions Court on every date unless granted exemption by the Sessions Court.
