Although, it is an admitted fact that non- applicant No.2 had left India and gone abroad without seeking permission of the Court, in violation of the condition imposed by this Court, the fact remains that he has returned to India and since 03/3/2016 he is attending the Court dates. The violation is certainly there, but due to subsequent conduct of non-applicant No.2, the severity of the consequences of the violation has been reduced considerably. In these circumstances, I am of the view that non-applicant No.2 needs to be given further chance to show his compliant nature. In this view of the matter, I am not inclined to allow this application. The application stands rejected. However, it is made clear that non-applicant No.2 shall not repeat this conduct and in case he desires to go abroad, he shall seek permission of the trial Court.
