2] After the death of father of the applicant, applicant along with her minor daughter, is residing with her mother in Nagpur whereas the non-applicant is residing in Bombay.

3] Considering the hardship, the distance between two places i.e. Nagpur and Bombay where the proceedings are pending, the applicant is custodian of minor daughter and her financial condition as it is claimed that no maintenance is paid by the non-applicant, it will be appropriate to allow the application in terms of prayer clause (i). Order accordingly. No costs.
