Hearing was conducted through Video Conferencing and the learned counsel agreed that the audio and visual quality was proper.

Applicant is apprehending to be arrested in connection with Crime No. 595/2020 registered at Police Station Frezarpura, Tal. and Dist. Amravati relating to offence punishable under Section 409 of the Indian Penal Code. The applicant was employee in S.R.P.F and was incharge of Water Supply Unit. It was came to the

knowledge that certain quantity of brass tap cocks and stop cocks worth Rs. 1,51,079 are missing rather was from the custody of applicant. The departmental inquiry was held in which applicant was held responsible for missing of articles and was directed to pay Rs. 10,000/-.

It is stand of applicant that while he took charge as in-charge of Water Supply Unit, he did not receive those articles. Moreover, it is submitted that inquiry conducted by the department only blamed about negligence and furthermore, held that applicant is responsible with some other employees.

The amount of misappropriation is to the tune of Rs. 1,51,079/-. Applicant who is public servant has already faced departmental inquiry. There are less chances of applicant of fleeing from justice. Having regard to the nature of accusation, pre-arrest protection can be granted

on certain terms. Hence, following order:- 5.

The interim order date 24.07.2020 is hereby made absolute with further direction to attend concerned Police Station on every Monday between 10.00 a.m. to 12.00 noon till filing of charge-sheet.

Application stands disposed of.

The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.
