By this application, the applicant is seeking amendment to Criminal Revision Application which is is filed under Section 397 of the Code of Criminal Procedure, due to change in circumstances.

As per the contention of the applicant the original criminal revision was filed on the basis that criminal application under Section 340 of the Cr.P.C. vide CMA No.17/2023 was pending before the Family Court, on the day when the original revision was filed. Subsequently, the said CMA was decided by the Family Court and therefore, one of the prayer made in the original revision has become infructuous and therefore, by this application, he is seeking permission to delete the said prayer. As the proposed amendment is not causing any prejudice to the other side, the application is allowed.

The applicant is directed to carry out the amendment within 14 days and amended copy be placed on record and be supplied to the other side also.

The criminal application APPR No.74/2025 is disposed of.

Considering the controversy which is raised by hearing this application, both the sides i.e. applicant who is appearing in person and learned Counsel for the non-applicant shall make a statement in a tabular form as to the dues which are recoverable including the statement which amount they have received.
