Though the claim of the petitioners for deciding compensation under Section 28A of the Land Acquisition Act, 1894 has been determined way back in 2007, the petitioners have not been paid their due amount and, therefore, the petitioners are required to knock the doors of this Court, as evident from the news report.

Respondent no.2 is directed to make payment to the petitioners of their dues along with interest as provided in the statute within a period of three months from today. It is further to be seen that though the demand has been made, time and again by the Land Acquisition Officer, respondent no.2 did not pay any heed to it.

wp.3680.15 2/2 In that view of the matter, since we find the approach of respondent no.2 is throughout casual and callous, each of the petitioners in addition to what has been directed in the award, would be entitled to costs of Rs.10,000/- per head. JUDGE JUDGE *sdw
