The learned A.P.P. has pointed out that there is some past police history insofar as the applicant no.1 is concerned.

In this situation, we do not wish to go into the merits or demerits thereof. The extraordinary remedy cannot be used against the complainant and to defeat the criminal adjudication.

Hence, without recording anything on merits of the controversy, we refuse to entertain the criminal application. The criminal application is disposed of accordingly.
