Heard Shri A.I. Shah, learned Counsel for the applicants, Shri R.S. Nayak, learned A.P.P. for nonapplicant no.1 and Shri A.K. Chatterjee, learned Counsel for non-applicant no.2.

It is not in dispute that matrimonial discord between parties is amicably settled. Family Court has on 15.07.2015, while deciding Case No. A917/2013, granted decree of divorce by mutual consent.

Respective counsel state that as marriage itself is dissolved, charge-sheet and Regular Criminal

Order 1511apl250.16 Case before the Judicial Magistrate First Class, Court No.6 at Nagpur should be quashed and set aside. 4.

We have heard learned A.P.P. We find that the dispute is purely of a private nature. As such we make rule absolute, by quashing charge sheet bearing No. 124/2014 arising out of Crime No. 508/2013 and also Regular Criminal Case No. 18136/2014 pending before the Court of Judicial Magistrate First Class No.6, Nagpur.

Criminal Application is accordingly disposed of. No costs.
