Date : 9th September, 2019 This petition challenges the decision of the respondentBharat Petroleum Corporation Ltd., Nagpur, containing the communication dated 18-3-2019, holding the petitioner as ineligible for award of RO (Petrol Pump) Dealership at Location No.131 at Mouza Kodamethi on MDR 35, Tahsil Mouda, District Nagpur.

On 27-3-2019, we passed an order as under :

Heard.

Issue notice for final disposal of the matter, returnable on 13th June, 2019.

The petitioner has complied with the deficiencies pointed out in the communication dated 19th February,

0909wp2496.19.odt 2019 for award of a retail outlet petrol Pump dealership at Location No.131. However, ignoring compliance, the communication is issued on 18th March, 2019 informing that the petitioner is found to be ineligible as he has failed to submit certain documents. By way of an interim order, we direct the respondent to re-consider the issue in the light of claim of the petitioner of submission of documents under the covering letter dated 11th March, 2019, and to point out if any specific deficiency is there. So far as allotment of dealership to other candidate in place of petitioner is concerned, same shall remain stayed."

In response to the aforesaid order, the respondent has re-considered the case of the petitioner and accordingly the candidature of the petitioner has been reinstated as per the communication dated 22-8-2019.

In view of above, the grievance of the petitioner does not survive.

The petition is dismissed as infructuous.
