The departmental enquiry conducted against the petitioner, which has been questioned in this petition, has been completed and it appears that Disciplinary Authority has not recorded any findings regarding acceptance of the enquiry report or otherwise. If the Disciplinary Authority accepts the enquiry report and imposes punishment upon the petitioner, complications may arise if this application seeking release of the entire pensionary benefits and other retiral benefits is allowed. The application appears to be prematurely filed and therefore, the application is rejected.

We direct respondent Nos.2 and 3 to file reply in the matter.
