The learned Counsel for the applicant though undertaken, has not filed his Vakalatnama. He however, submits that the applicant has surrendered before the concerned police station and he has been remanded in police custody by the concerned Magistrate.

It appears from the record that some time was sought by the learned counsel for the

Order 1907aba313.21 applicant for taking instructions for withdrawal and filing of Vakalatnama.

Any how, though Vakalatnama has not been filed, it appears that the applicant is not interested in prosecuting the matter, perhaps the reason may be of his arrest. Accepting statement of the learned Counsel for the applicant that since the applicant is arrested, his application has become infructuous, the same is disposed of as such.

Since Vakalatnama has not been filed, in case the applicant is not arrested, than his right to approach this Court is kept open.
