In view of averments made on behalf of the respondents in paragraph 5 of the affidavit dated 11/09/2014 wherein it is stated that the respondents shall reassess the property in question under provisions of the Maharashtra Municipal Corporations Act, 1949, it is clear that the grievance of the petitioner for the present does not survive.

The petition is therefore disposed of by permitting the respondent to reassess the property in question in terms of provisions of the Maharashtra Municipal Corporations Act, 1949. The representation dated 28/11/2013 shall be taken into consideration by the respondents while undertaking said assessment. Writ Petition is disposed of in aforesaid terms with no order as to costs.
