Dated : 16 th April, 2015 The nomination form of the petitioner-Society has been rejected on the basis of the provisions of Bye-Law Nos.35(2)(A)(2) and 35(2)(A)(5) of the Bye-Laws of the Petitioner-Society on the ground that the petitioner-Society is not the borrower-member of the Gadchiroli District Central Co-operative Bank Ltd. The petitioner has got an alternate remedy of filing a dispute under Section 91 of the Maharashtra Co-operative Societies Act, 1960.

The petition is dismissed on this sole ground. All questions are kept open to be agitated in appropriate proceedings. Steno copy of this order be supplied to the learned counsel for the petitioner.
