Heard the learned Counsel for the rival parties.

Perused the chargesheet and the statements of the witnesses. Looking to the role played by the applicant prior to the actual incident of assault, I think the applicant deserves to be released on bail. The further evidence is that he was merely seen going on motorcycle. Prima face, it is not sufficient to curtail the liberty of the applicant. However, the offence being serious, the condition to ask the applicant not to enter the Akola town will have to be imposed, I make the following order :- Order A] Criminal Application (BA) No.252 of 2015 is allowed.

B] The applicant shall be released on bail on furnishing a PR bond in the sum of Rs. 10,000/- with one solvent surety in the like amount.

C] The applicant shall not enter the boundary of Akola town till the trial is over except on the dates of hearing.

Criminal Application (APPP) No.559 of Heard.

In view of grant of main application, this application has become infructuous.

Hence, it is dismissed as infructuous.
