Shri Mir Nagman Ali, the learned Counsel states that since the amount of compensation of Rs.1,10,000/- is deposited with the Trial Court pursuant to the order dated 05.04.2018, nothing survives in the criminal application. 2] Shri Alaspurkar, the learned Counsel for the non-applicant does not controvert the submission. However, he would pray that the complainant be permitted to withdraw the said amount.

3] The complainant is permitted to make appropriate application for withdrawal of the amount before the Appellate Court since the appeal challenging the conviction is pending. If such application is made, the same shall be considered on its own merits.

4] The application is disposed of.
