Mr.M.I.Dhatrak, learned counsel appearing for the respondent-Municipal Council, on instructions, submits that within a period of six months, amount of Rs.39,000/- towards gratuity and Rs.4,51,620/- towards leave encashment would be paid to the petitioner. 2.

The petitioner also claims the amount admissible for commutation of pension. In the reply filed by the Municipal Council, it has been stated that it's financial condition is not sound and the aforesaid claim would be satisfied as and when the financial condition of the Municipal Council improves.

In this regard, leave is granted to the petitioner to take appropriate steps, if the amount of commutation of pension is not paid to him within a period of one year from today.
