The applicant is arrested on 14th March, 2015 in connection with crime registered against him for the offence punishable under Section 420 read with Section 34 of the Indian Penal Code and Section 3 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999.

On 20th June, 2017 a submission was made on behalf of the applicant that if he is granted temporary bail, he may arrange and deposit Rs.10,00,000/- with the Investigating Agency. Accepting the submission made on behalf of the applicant, an order was passed directing the non-applicant to release the applicant on temporary bail till 10th July, 2017 on executing P. R. Bond for Rs.1,00,000/- and furnishing two solvent sureties in the like amount. The learned advocate for the applicant has submitted that the applicant could not arrange for two solvent sureties and therefore, he continued to be in jail. It is submitted that in case the applicant succeeds in furnishing

2 ba313.17 two solvent sureties as directed by the order passed on 20th June, 2017, the applicant may be permitted to approach the Sessions Court for further steps in the matter. Considering the facts of the case, the order passed on 20th June, 2017 is recalled and the Criminal Application (BA) No.313 of 2017 is dismissed.
