By this application, the applicant seeks condonation of delay of 1118 days caused in preferring the criminal appeal. 3.

The contention of the learned counsel appearing for the applicant is that the applicant is a poor person and he has no knowledge of filing the appeal, after the conviction. He is behind the bar since the year of 2019. At that time, he was not in a capacity to engage an Advocate. Now, he has engaged an Advocate and filed the criminal appeal, therefore, the delay may be condoned.

Considering the fact that the criminal appeal is a statutory right and for the reasons mentioned in the application, the delay of 1118 days caused in preferring the appeal is condoned. The application is allowed and disposed of accordingly. 5.

Appeal be registered and numbered accordingly. CRIMINAL APPEAL (ST) NO.2785 OF 2024.
