Date : 7 th October, 2015 The petitioner was removed from the post of Sarpanch under Section 39(1) of the Bombay Village Panchayats Act, 1958 on the ground that he was found guilty of certain charges levelled against him. The order of disqualification was passed on 9-4-2009 and this Court granted stay to the said order on 30-4-2009, which was continued during the pendency of the petition. The election for the post of Sarpanch was held on 10-5-2005. The tenure of Sarpanch has already expired.

Thus, the petition has become infructuous and the same is dismissed as such.
