In morning session, when this appeal was called out, nobody was present and, therefore, the matter was kept in second half.

In second half also, when the matter is called out, learned counsel for appellants and appellants are absent. Learned counsel Ms A.S.Athalye for respondent No.3 is present.

Record shows that even at the time of admission of the appeal, learned counsel for appellants was absent. However, since it was appeal, arising out of motor accident claim, the appeal was admitted.

After admission of the appeal, it was incumbent on the part of appellants to file private paper book, however it was not filed. Therefore, the matter was listed before this Court (Coram : Smt.Anuja Prabhudessai, J.) on 29.1.2021. .....2/-

It appears that appellants and their counsel have lost their interest in prosecuting the appeal. 6.

Hence, the first appeal is dismissed for want of prosecution.
