Dharmadhikari, AGP for applicants CORAM : MANISH PITALE, J.
DATE : 14 MARCH 2022 These applications are another illustration of inertia and recalcitrance with which the Government functionaries approach the Court and keep matters languishing on one count or the other. In these cases, the learned Registrar passed the order as far back as on 27/02/2017, granting stipulated period of time for removal of office objections and due to failure of removal of objections, the writ petitions were not registered and stood effectively rejected on that count.
2.
Mr. K.L. Dharmadhikari, learned Assistant Government Pleader states that although the applications were filed on MP Deshpande
2 / 2 1-cao-821-2017 23/03/2017, they remained pending. Record also shows that in February 2020, notices were issued on these applications. Office note shows that respondents have been served. 3.
The main petitions are concerned with the question of reinstatement and back wages of workmen.
4.
In normal course, this Court would have been slow in restoring such petitions, but, since the writ petitions can be taken up at least on the question of back wages and some reliefs can be granted to the workmen, the applications can be considered favourably.
5.
The applications are allowed in the interest of justice. As a consequence, the writ petitions are restored. The office objections shall be removed within one week from today.
6.
List both the writ petitions for consideration on merits on 30/03/2022.
7.
It is made clear that even if the office objections are not removed, the writ petitions shall be listed on the said date and they be taken up for consideration on merits.
8.
Civil applications are disposed of.
