DATED :- 25.02.2020 1] Heard Shri Thakkar, learned Counsel for the appellant. He informs that the appellant has expired long back. The appellant was convicted for the offence punishable under Section 304-II of the Indian Penal Code and was sentenced to undergo rigorous imprisonment of three years with fine.

2] This Court by order dated 16th June, 2006 ordered his release.

3] The farad noting dated 4th May, 2019 reflects that the accused was released from jail after undergoing imprisonment. The Superintendent of Central Jail, Nagpur vide communication dated 16th April, 2019 has informed that the accused has already undergone imprisonment of three years and has paid fine of

apeal223.06.odt Rs.500/-. After undergoing complete punishment, he was released on 11th June, 2007.

4] In the backdrop of aforesaid record and the submissions of the learned Counsel for the appellant Shri Thakkar that the accused / appellant has already expired, the appeal stands dismissed as abated.
