DATED : DECEMBER 03, 2019 This is an application filed on behalf of the petitioner seeking amendment of the petition in order to place on record certain developments relevant to the controversy in the present case. The petitioner also desires to place on record a document which is relevant for the subsequent developments brought on record.

Such an amendment in ordinary course would have been allowed without any condition, but, the record shows that notice in the present writ petition was issued as far back on 08/02/2017 and till date the petitioner did not care to get the said application listed for orders. Not only this, copies also were not supplied for issuance of notice in the writ petition, wherein as noted above, notice had been issued as far back on 08/02/2017.

In this backdrop, the present application for amendment is allowed subject to the condition that the petitioner shall deposit an amount of Rs.5000/- (Rs. Five Thousand only) towards costs with the High Court Bar Association at Nagpur.

Upon such deposit of costs within a period of two weeks, the petitioner shall be permitted to carry out the amendment.

Writ Petition No.5138/2016 The petitioner is permitted to supply copies for issuance of notice subject to aforementioned costs imposed for allowing application for amendment. Copies be supplied after deposit of costs and carrying out amendment within a period of two weeks from carrying out amendment.

Civil Application (CAW) No.835/2017 in W.P.

No.5138/2016 This is an application seeking modification of interim order dated 08/02/2017.
