Heard Shri C.A.Joshi, advocate for the applicants and Shri K.R.Lule, A.P.P. for the non-applicant. The applicants apprehend arrest in crime registered against them for the offences punishable under Sections 498-A, 306 and 34 of the Indian Penal Code. The marriage between the applicant No.1 and deceased Sau. Asmita was solemnized on 2nd July, 2006. The couple has two daughters aged about 8 years and 4 years. The applicant No.1 is working as Lecturer in College at Washim. The crime is registered against the applicants, mother of applicant No.1 and Hemant, son of elder brother of the applicant No.1. Hemant is aged about 15 years. The accusations against the applicants are on the basis of circumstantial evidence as the incident has occurred in the house of the applicants. Considering the nature of the incident, the accusations against the applicants and as the non-applicant has not been able to show that the custody of the applicants is required for further investigation, the applicants are entitled for pre-arrest bail.
2 aba211.16 Hence, the following order :
In the event of arrest in Crime No. 103 of 2016, registered by the non-applicant, the applicants be released on bail on furnishing P.R. bond for Rs.Twenty Five Thousand each and two solvent sureties in the like amount for each of the applicant.
The application is allowed accordingly.
