CRIMINAL APPLICATION (BA) NO. 481/2021.

Heard.

2] Vide order dated 08/12/2020 passed in Criminal Application (BA) No. 1096/2020, this Court had directed the trial Court to record the statement of the daughter of the present applicant, who is an eye-witness, within a period of three months from the date of passing of that order, if the trial Court decides to frame charge.

3] The instant application came to be moved as there was a delay in recording the statement of the daughter of the applicant.

4] Now, Shri Deshpande, learned counsel for the applicant, so also Mrs. Deshmukh, learned

A.P.P., jointly submit that the trial Court has recorded the statement of the daughter of the applicant. 5] This Court, in para 6 of the aforesaid order, has observed as under :

"6] Considering the role attributed to the present applicant, so also considering the fact that she is a lady, this Court is of the firm view that she would be entitled for bail after recording of evidence of her daughter has been done."

6] As the evidence of the daughter of the applicant came to be recorded by the trial Court, as submitted by the learned counsel appearing for the parties, I proceed to pass the following order :

ORDER

i.

The Criminal Application is allowed.

ii.

The applicant Mehmooda Parveen Wasim Khan be released on bail in connection with Crime No. 225/2020 dated 06/06/2020 registered at Police Station, Khadan, District Akola for the offences punishable under Sections 302, 394, 460 and 201 read with Section 34 of the Indian Penal Code, on her furnishing PR bond in the sum of Rs.25,000/- (rupees twenty five thousand) with one solvent surety in the like amount.

iii.

The applicant to attend the Court proceedings scrupulously.

7] The Criminal Application stands disposed of accordingly.

8] As the evidence of the witness has already been recorded, the request made by the trial Court in the letter dated 03/05/2021 to extend time to record evidence of witness, needs no consideration, since rendered redundant.
