Petitioners challenge is to ad-interim order dated 11-06-2024 passed by the Industrial Court, Akola, on an application Exhibit-U-2 under Section 30(2) of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971 (for short, ' MRTU and PULP Act'
). The impugned order is an ad-interim order which is passed on the main application which is pending consideration before the Industrial Court. Learned Counsel for the petitioners submits that the petitioner/Corporation is considering the application of the respondent for compassionate appointment on Class-IV post as per the policy in force. Since the impugned order is only with respect to challenge to the adinterim order, it is in the interest to direct the Industrial Court, Akola to decide the main application. The petitioners are entitled to take decision about the application of the respondent for compassionate appointment in Class-IV category. Learned Counsel for respondent submits that the respondent'
s claim for appointment on compassionate ground on Class-IV post needs to be considered first.

In view of this, writ Petition is disposed of with direction to the petitioners to consider and decide the respondent' s application for compassionate appointment on Class-IV post within a period of one month from today.

Industrial Court, Akola is also directed to consider and decide the pending application under Section 30(2) of the MRTU and PULP Act at Exhibit-U-2 after the petitioner takes decision on the application for compassionate appointment.
