The learned Advocate Mr. Patil appearing for the appellant submitted that by order dated 23.11.2022 this Court has directed to deposit balance decretal amount of the compensation which is awarded by the reference Court. Thereafter, time was extended to deposit the decretal amount. Now, he has received the cheque from the acquiring body and he will deposit the same within one week.

The appellant is permitted to deposit the cheque of balance decreetal amount within one week. Civil Application (CAF) No.

2590/2022 1.

By this application, the applicant is seeking stay to the effect, execution and operation of impugned award dated 7.11.2019 passed by Civil Judge Senior

(2) 39.fa.920.2022 Division, Achalpur in Land Acquisition Case No.20 of 2014.

The applicant is already permitted to deposit the balance amount. On depositing the balance decretal amount, the award passed by the Civil Judge Senior Division, Achalpur is stayed, till disposal of the appeal. On failure to deposit the amount, the stay will be automatically vacated without further reference to the Court.

Civil Application No.2590/2022 is disposed of.

Appeal be placed after two weeks.
