This is an application seeking condonation of delay of 35 days caused in filing second appeal. The office note shows that non-applicant Nos.(i) to (iii) are served through regular mode and non-applicant No.1(iv) is served by private mode. The non-applicants have not entered appearance in the matter. It is stated in the application that the delay occurred because the modalities for finalizing the draft of the memorandum of appeal took time, which was finalized in consultation with the learned Advocate representing the applicants before the learned trial Court and the learned First Appellate Court.

Having regard to the reasons mentioned in the application, delay of 35 days caused in filing second appeal deserves to be condoned and is condoned. Civil Application is allowed.
