By this petition, the petitioner challenges the order passed by the respondent no.4-Assistant Commissioner, Social Welfare Department, dated 6.3.2014. The petitioner seeks his absorption in some other School as a surplus teacher. Shri K.L Dharmadhikari, the learned Assistant Government Pleader appearing on behalf of the respondent nos.1 to 4 states that during the pendency of the Writ Petition, the Appeal filed by the petitioner before the respondent no.2Regional Deputy Commissioner, Social Welfare - Appellate Authority is decided by an order dated 4.2.2015. It is stated that most of the issues involved in this petition were also involved in the Appeal filed before the respondent no.2. It is stated that the petitioner has not challenged the order in Appeal and the petitioner should not be permitted to prosecute this Writ Petition.
Shri V. N. Patre, the learned counsel for the
2 28.04.wp.2046.14. petitioner seeks permission to withdraw the Writ Petition with liberty to challenge the order dated 4.2.2015 before the appropriate authority-forum.
We grant the prayer for withdrawal. The Writ Petition stands disposed of as withdrawn, with liberty. No order as to costs.
