Heard Shri J.S. Chilotra, learned counsel for the applicant and Shri A.R. Chutke, learned A.P.P. for the State through Video Conferencing.
The applicant is already protected by this Court by way of an ad interim anticipatory bail vide order dated 16/06/2020.
Learned counsel for the applicant submitted that counter reports have been lodged in the instant case and the entire matter arises out of political rivalry, which is given color of criminal matter. He further submitted that co-accused Nos.11, 12, 14 and 15 have already been released on bail. That nothing is required to be seized from the present applicant and therefore, custodial interrogation is not required and thus prayed for granting ad interim protection to the applicant. I have perused the affidavit-in-reply filed on behalf of the State wherefrom the prosecution could not point out any specific role attributed to the present applicant nor any criminal antecedent against him.Also,
14 LDVC ABA 142.2020 no any vital weapon used by the present applicant. Undisputedly, the co-accused in the instant case have already been released on anticipatory bail. In such circumstances, I am inclined to allow the application and the same is accordingly allowed. The ad interim protection earlier granted to the applicant by this Court vide order dated 16/06/2020 is hereby confirmed on the same conditions.
The Criminal Application is disposed of accordingly.
