The prosecution has not filed any additional affidavit in this case as the learned APP submits that he has not received any instructions in the matter.

The additional affidavit was to be filed by the prosecution to clarify as to whether this applicant was the owner of the four vehicles from which contraband liquor was seized, as it was the contentions of the applicant that he was never the owner of any of these vehicles. The details of the ownership of the vehicles are also not placed on record so as to substantiate the contention of the Investigating Officer that this applicant was now the registered owner of the vehicles in question. If this is

ABA213.18 so, I am of the view that this is fit case for grant of anticipatory bail.

In the result, the application is allowed.

Ad-interim anticipatory bail granted to this applicant by this Court on 28th March, 2018 is hereby confirmed on the same conditions, with the clarification that, now this applicant need not attend the police station except when he is called upon to do so by the Investigating Officer.
