The applicant, apprehending arrest in crime registered against him for the offence punishable under Sections 324, 354 and 34 of the Indian Penal Code, has sought pre-arrest bail. The crime is registered on complaint lodged by Ramesh Tule that when he had gone out for stroll after dinner with his granddaughter -Aaradhya, near a Paan Shop applicant and co-accused Hiraman Gawande and Gajanan Wahkhade abused the complainant and assaulted him by stone, snatched the gold chain of the complainant, took away amount of Rs.10,000/- from the complainant and when the daughter of the complainant-Sau. Anita came there the applicant pulled her gown.
The application is opposed on the ground that earlier also two crimes are registered against the applicants and the custody of the applicant is required for interrogation as the gold chain and cash has to be recovered.
2 aba216.17 The learned advocate for the applicant has submitted that the applicant is working as Clerk in Central Bank of India. It is submitted that in both the crimes registered against the applicant there is settlement between the complainant and the applicant and one of it is disposed by the Court.
There is no independent witness. This Court has granted interim protection to the applicant by order passed on 5th April, 2017, the Investigating Agency has not complained that the application has misused the interim protection and has not co-operated with the Investigating Agency. Other two co-accused are granted pre-arrest bail by the Sessions Court.
Considering the facts of the case, the order passed by this Court on 5th April, 2017 granting protection to the applicant is confirmed.
The application is allowed accordingly.

In view of disposal of the bail application, the application praying for time to file copy of say does not survive, hence, the application is disposed of. JUDGE RRaut..
