IN THE COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR WRIT PETITION NO. 4586 /2015 (Shri Gopal s/o Ganesh Padhye vs. State of Maharashtra and others ) ................................................................................................................................................ Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's order of directions and Registrar's orders ................................................................................................................................................ Shri S.J.Khandalkar, Advocate for the petitioner Shri A.S.Fulzele, Addl. Govt. Pleader for Respondent no.1 CORAM : SMT. VASANTI A. NAIK & A.I.S. CHEEMA, JJ.

DATED : 19th October, 2015.

Heard.

The only prayer made by the petitioner is for a direction to the Executing Court, i.e. 4th Joint Civil Judge, Senior Division, Nagpur to conclude the execution proceedings within a period of two months.

On a perusal of the Roznama (order sheet), it appears that the prayer made by the petitioner for a direction to the executing Court to decide the execution proceedings within a period of two months, cannot be granted. We find that the matter is fixed before the executing Court for hearing on several exhibits.

19.10.wp.4586.15 In the circumstances of the case, we dispose of the Writ Petition only with a direction to the executing Court to decide the execution proceedings as early as possible. Since the direction is innocuous, we had not issued notice to the respondents.

Order accordingly. No costs.

JUDGE JUDGE sahare
