Shri Thakare, learned APP for the respondents has tendered report of Post Mortem. The same is taken on record and marked as Exh. X. Its copy is also served upon Shri Chopde, learned counsel for the petitioners.

The learned counsel for the petitioners is seeking time to obtain instructions. However, we find that nothing material has come in post mortem report. Death of the deceased due to drowning is found confirmed on account of diatom test. In view of this, we are not inclined to keep the matter pending. With liberty to the petitioner to take such other steps as are open in law, we dispose of the petition.

Criminal Writ Petition is disposed of as withdrawn. No costs.
