DATE : November 17, 2015 In the present writ petition, the petitioner who was elected as Sarpanch was sought to be removed by moving a motion of no-confidence. This motion was passed on 02/09/2008. The same was challenged by filing proceedings on 06/09/2008 under Section 35(3B) of the Maharashtra Village Panchayats Act, 1958. The Additional Collector rejected the application and held the motion to be valid. This order was confirmed by the Additional Commissioner by order dated 31/03/2009. Due to passage of time and the fact that the elective term would have come to an end by this time, the writ petition is disposed of as having been rendered infructuous with no order as to costs.
