For the reasons mentioned in the application, the same is allowed and writ petition is restored to file. WRIT PETITION NO. 1165 OF 2018 Heard Shri R.R. Vyas, learned counsel for the petitioner for some time.

The impression, prima facie given is, the petitioner and the respondent together have resorted to advance booking and got the land booked. The question before this Court is, whether in such circumstances, the plot can be auctioned and general public can be permitted to offer bids at market price for it.

Shri Vyas, learned counsel, however, has invited

0309mca922.18 our attention to a Circular dated 23.10.2015 which, according to him, ought to have been used in present facts to revive and support the proposal of the petitioner. 4.

In view of this circular, keeping all other points open, notice, returnable on 15.10.2018.
