Heard the learned Counsel for the rival parties.

Seen the interim order passed by this Court on 18-04-2015. Though it is alleged that the applicant had planted somebody for execution of sale deed, the lengthy reply filed by the prosecution does not indicate any specific or even any vague statement as to who saw the applicant doing so. The Counsel for the applicant submits that there is nothing on record to implicate the applicant who merely signed it as witness. I have perused the sale deed and I find the statement to be correct.

At any rate, whether the applicant has planted somebody at the time of

execution of sale deed at the office of the Sub-Registrar or not is a matter of evidence and no purpose would be served by allowing arrest of the applicant.

That being so, I make the following order :- O r d e r A] Criminal Application (ABA) No.197 of is granted.

Ad-interim protection granted to this applicant for the offences punishable under Sections 420, 468, 471 read with Section 34 of the Indian Penal Code by this Court on 18-04-2015 is confirmed and in the event of arrest, the appellant shall be released on bail upon furnishing PR bond in the sum of Rs. 10,000/- with one surety in the like amount.

B] The applicant shall cooperate with the Investigating Officer during investigation as and when called.

C] Criminal Application (ABA) No.197 of 2015 is disposed of.

Criminal Application (APPP) Nos.421 of 2015, 422 of 2015 and 424 of 2015 As the Criminal Application (ABA) No.197 of 2015 is disposed of, all the Criminal Applications have become infructuous. Hence, the same are disposed of as infructuous.
