31st July, 2017 By this application, it is prayed that the delay in filing the Second Appeal be condoned. The reasons for delay are mentioned in paras 3 to 5 of the application. The application is opposed by Shri Matale, learned counsel for the respondents by filing reply. It is denied that there is sufficient cause for condoning the delay.

Considering the averments made in the application, I am satisfied that the delay has not been deliberately caused. The reasons assigned appear to be

acceptable. Hence, delay in filing the Second Appeal stands condoned.
