In view of the statements in the praecipe which are supported by the postal receipt and acknowledgment of notice, the learned counsel Shri S.M. Nafde, is discharged. 3.

The appellant has not filed the private paperbook. 4.

None appears on behalf of the appellant.

Keeping the appeal pending would be futile since the appellant is obviously not interested in prosecuting this appeal which challenges the acquittal of the respondent 1 of offence punishable under Section 138 of the Negotiable Instruments Act, 1881.

In exercise of inherent powers, I dismiss the appeal with costs of Rs. 5,000/-.
