In view thereof, the second appeal is disposed of as settled.

Learned counsel for the appellant-original defendant, has invited my attention to order dated 07.11.2019, passed in Civil Application No.511/2019. The appellant made a statement that he will not withdraw the amount of Rs.60,000/- deposited by the respondent-plaintiff. Parties before the Court submit that the amount of Rs.60,000/- along with interest accrued thereon, if any, may be permitted to be withdrawn by the respondent-plaintiff. Permission is granted.
