DATE : 3.5.2016 Heard Shri P.R. Agrawal, advocate for the applicants and Shri A.D. Sonak, A.P.P. for the non-applicant. The applicants apprehend arrest in crime registered against them for the offences punishable under Sections 143, 324, 452, 376-D, 427 and 506 of the Indian Penal Code.

Similar complaint is made by the same complainant against four persons who are applicants in Criminal Application (ABA) No.217/2016.

There is civil dispute going on between the applicants and the complainant. The medical examination report of the complainant prima facie does not substantiate the accusations. Considering the accusations against the applicants and the facts on the record, in my view, the interim order granted on 6th April, 2016 is required to be confirmed.

Hence, the following order:

(i) In the event of arrest in Crime No.32/2016 registered by the

2 aba221.16 non-applicant, the applicants be released on bail on furnishing P.R. bond for Rs.10,000/- (Rs. Ten Thousand Only) each and one solvent surety in the like amount for each of the applicant. (ii) The application is allowed in the above terms. JUDGE Tambaskar.
