25th September, 2017 By this application, it is prayed that the possession of the applicant be protected during pendency of the appeal.

The appeal has been admitted after framing a substantial question of law. In para 3 of the application, it has been stated that the applicant is in possession and in view of dismissal of the suit, there is a threat to his possession.

The Collector, Wardha, has been appointed to represent the interests of the respondent who has expired issue-less.

In the facts of the case, during pendency of the appeal, the possession of the applicant shall remain protected. The applicant, however, shall not change the nature of the suit property or alienate the same. Civil Application is disposed of.
