The charge-sheet in the matter has already been filed on 24/12/2021. The applicant has been arrested on 22/11/2021. In the same crime, while considering Criminal Application (BA) No.255/2022, by an order dated 11/04/2022, I have enlarged Shivaji Sakharam Gaikwad/accused no.1 on bail.

Ms Udeshi, learned Additional Public Prosecutor for the non-applicant/State does not dispute that the position of the present applicant is similar to that of accused Shivaji Gaikwad and there is nothing, which would distinguish his position, considering which, in view of what has been held in Criminal Application (BA) No.255/2022 decided on 11/04/2022, I am inclined to allow the present application.

O R D E R

(i) The applicant/Akshay Gajanan Ambhore be released on bail in Crime No.357/2021 registered with Police Station Sakharkherda, District Buldhana, for the offence punishable under Section 379 read with Section 34 of Indian Penal Code, on his executing P.R. Bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) with two solvent sureties in like amount.

(ii) The applicant shall not directly or indirectly make any attempt to influence the witnesses or otherwise tamper with the prosecution evidence.

(iii) The applicant shall not be involved in any single offence in any nature of whatsoever and any such involvement shall result in cancellation of bail. (iv) The applicant shall attend each and every date before the learned Magistrate and also keep in touch with the Investigating Officer as well as at all times inform the learned Magistrate of his residence and telephone/mobile number.
