We are of the view that the application of Model Code of Conduct shall not have any bearing over the proceedings which are initiated and pending at the behest of the petitioner questioning the passing of No Confidence Motion against the petitioner.

As such, though resisted by the learned Assistant Government Pleader, we deem it appropriate to dispose of the petition with directions to respondent No.12 to decide the claim of the petitioner against the passing of No Confidence Motion expeditiously and in any event, within a period of two months from today. Needless to clarify that the election to the post of Sarpanch shall be subject to final outcome of the said decision. 4.

The petition is disposed of accordingly.
