Vaishnav, learned counsel for the petitioner, on instructions seeks permission to withdraw the present contempt petition by submitting that as the learned Joint Charity Commissioner in Application No.39/2017 has kept those proceedings in abeyance till the decision of the present proceedings, direction may be issued to the learned Joint Charity Commissioner to decide the said proceedings on their own merits. He submits that the life membership of the respondent No.1 has been put to an end by virtue of resolution dated 22/11/2016 bearing No.3(B). Passing of this resolution is disputed by the learned counsel for the respondent.
We are not inclined to go into these disputed facts in the present proceedings. The contempt petition is permitted to be withdrawn. The learned Joint Charity Commissioner shall decide the proceedings pending before
8-CP-114-18 2/2 him on its own merits and in accordance with law. If after such adjudication the petitioner feels there has been breach of joint pursis in Writ Petition No.4322/2016, it is free to take such steps as are permissible in law.
Contempt Petition is disposed of as withdrawn. No costs.
