Heard.

The applicant, woman aged about 29 years, is arrested in crime registered against her and four others for the offences punishable under Sections 302 and 120-B of the Indian Penal Code. The accusations against the applicant are that she has conspired in killing of her mother-in-law Batunbee who was employed with Western Coalfields Ltd. and was on the verge of retirement, so that her husband (son of Batunbee) gets appointment on compassionate ground in place of Batunbee.

The Investigating Agency has opposed the application on the ground that the statements of co-accused show that the applicant gave contract to kill Batunbee and paid the amount to the co-accused who have murdered the victim.

2 ba326.17 The chargesheet is filed on 07/02/2017. The non-applicant has not been able to show that the custody of the applicant is required for further investigation. Considering the facts of the case, the following order is passed :

The applicant having been arrested in Crime No.225/2016, registered by the non-applicant, she be released on bail on executing P.R. Bond for Rs.Fifty Thousand and on furnishing two solvent sureties in the like amount.

The application is allowed in the above terms. CRI.APPLN.(APPP) NO.560/2017 In view of disposal of the bail application, the application praying for grant of time to file affidavit of relative does not survive, hence, it is disposed of. JUDGE RRaut..
